Terms and Conditions

Introduction

These terms and conditions ("Terms and Conditions") apply to all products and services provided by Montana Custom Beams ("the Company") to the customer ("Customer"). By engaging the Company for its services or purchasing its products, the Customer agrees to be bound by these Terms and Conditions. The Company reserves the right to modify these Terms and Conditions at any time without prior notice.

Estimates and Quotes

All estimates provided by the Company are based on the information available at the time of the quote and are subject to change. The final price for products and services will be guaranteed upon receipt of full payment, subject to any changes in specifications, additional requests, or unforeseen circumstances. The estimated timeline for project completion is not guaranteed and may be subject to change due to factors such as weather, log availability, force majeure, or other unforeseen issues.

Payment Terms

Unless specifically stated otherwise, full payment is required before any work begins on the project. Payments can be made via the methods specified on the invoice. Failure to make timely payments may result in delays or cancellations of the project.

Timber Grading

All timbers provided by the Company are appearance graded, and the Company does not provide grade stamped timbers unless explicitly stated as "Certified Grade Stamped" on the invoice with an accompanying charge as a separate line item. Customers requiring grade stamped timbers must indicate this requirement at the time of order placement.

Product Inspection and Claims

The Customer is responsible for inspecting the products upon receipt. Any defects or issues must be reported to the Company within seven (7) days of receiving the products. Failure to report defects or issues within the specified time frame will result in the Company being released from any liability for said defects or issues.

Wood Characteristics and Shrinkage

Wood is a natural product and is subject to inherent characteristics such as checking, twisting, shrinkage, and other variations in appearance. The Company is not liable for any issues arising from these natural characteristics, and the Customer acknowledges that such variations are to be expected when purchasing wood products.

Customer Specifications and Engineering Requirements

The Customer is responsible for providing accurate dimensions and specifications for the products ordered. The Company makes no claims or guarantees regarding the load-bearing capability of any timber. Any engineering requirements or specifications related to the use of the timbers are the responsibility of the Customer and must be provided at the time of order placement.

Shipping

Shipping prices are quoted using third-party carriers and are not guaranteed. Shipping is the responsibility of the Customer, including any damages or delays that may occur during shipping. The Company is not liable for any issues arising from the shipping process.

Handling Blemishes

Timbers may have dog-marks, chain-marks, or other blemishes due to handling. The Customer acknowledges and accepts that such blemishes are inherent to the nature of the timber industry and will not be considered defects.

Circle-Saw Mill and S4S Request

The Company operates as a circle-saw mill, and the wood products provided will have marks consistent with this process. If the Customer requires S4S (surfaced four sides) products, this request must be made at the time of order placement and indicated on the quote.

S4S (P) Product Dimensions

All surfaced four sides (S4S) products will be finished at 1/2" under the ordered dimensions. The Customer acknowledges and accepts this dimensional tolerance when ordering S4S products.

Kiln Drying (KD)

Kiln drying timbers offers various benefits, including reduced moisture content, enhanced dimensional stability, and a lower likelihood of mold and insect infestations. However, there are also potential drawbacks to consider, such as the increased risk of more dramatic splitting or checking, potential loss of natural character, and the possibility of the wood becoming overly dry for certain applications. Most timbers that we ship are not kiln dried at the request of our customers. The decision to kiln dry timbers should be made based on the specific requirements of each project, weighing both the advantages and disadvantages. Kiln drying of wood products provided by Montana Custom Beams does not guarantee any specific moisture content unless explicitly stated on the quote. It is important to note that kiln drying may not always be the optimal choice for all applications and uses, as its suitability depends on factors such as the intended indoor or outdoor placement and whether the wood is free of heart center.

Supplemental Products

At times, the Company may arrange for supplemental products to be included in an order as a service to the Customer, such as tongue and groove, wood products in sizes or species not available in the Company's inventory, or other related items. The Company cannot guarantee the quality or performance of these supplemental products, as they are not manufactured by the Company. The Customer assumes all responsibility for the use and suitability of supplemental products.

Force Majeure

The Company shall not be liable for any delays, cancellations, or failures to perform its obligations under these Terms and Conditions due to events beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, civil unrest, labor disputes, or other force majeure events.

Limitation of Liability

To the maximum extent permitted by law, the Company's liability for any claims arising from the products or services provided shall be limited to the amount paid by the Customer for the specific product or service giving rise to the claim. The Company shall not be liable for any indirect, consequential, or special damages, including, but not limited to, loss of profits, loss of business, or other economic losses.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which the Company operates. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the same state.

Severability

If any provision of these Terms and Conditions is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms and Conditions constitute the entire agreement between the Customer and the Company concerning the subject matter herein and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter.
In the event that any aspect of our rights or obligations is inadvertently omitted from these Terms and Conditions, such omission shall not constitute a waiver of those rights or obligations, nor shall it imply any guarantees or assurances not explicitly stated within these Terms. Montana Custom Beams retains all rights and protections provided by applicable laws and regulations, even if they are not expressly enumerated in these Terms and Conditions.
